Terms of service
Version 2026-09-10 · In force from 10 September 2026.
These terms form the contract between you and International Micro Services for the use of Tender Africa. They go together with our privacy policy and our Deleting your account page.
The short version
- — Tender Africa gathers tenders published by public buyers and analyses them. The official notice and tender dossier always prevail: check them on the buyer’s portal before you bid.
- — AI-generated analyses help you decide; they can be wrong and are not legal or financial advice.
- — Prices are shown excluding tax on the Pricing page. Payment is by bank transfer; a subscription lasts a month or a year and does not renew by itself.
- — Credits are spent per analysis, at the price shown before you click; a failed analysis is credited back. Credits have no cash value.
- — Moroccan law; if there is a dispute, we first look for an amicable solution.
1. Who we are
Tender Africa is published by International Micro Services ("IMS", "we"), a company incorporated in Morocco, with its registered office at R403 Technopark Rabat, Maroc — tax ID (IF) 66998567, ICE 003756193000072. Contact: contact@tender.africa.
2. Purpose and acceptance
These terms govern access to the tender.africa website and app, the API and the connector for AI assistants (together, the "Service"), free and paid.
You accept them by ticking the box provided at sign-up, or by continuing with Google where the sign-in screen says so. We record the date of your acceptance and the version you accepted.
The Service is intended for professionals — companies, consultancies, freelancers — who bid or consider bidding for contracts. If you use it on behalf of a company, you confirm you are authorised to bind it. If you are a consumer within the meaning of Law No. 31-08, the rights that law gives you apply in addition to these terms (section 11).
You must be at least 18 years old.
3. Definitions
- — Account: the space opened in your name, and the billing account it belongs to. A billing account can bring together several users from the same company, up to the seats of its plan.
- — Plan: the free or paid offer attached to the account, described on the Pricing page.
- — Credits: the unit spent when you request an analysis or a dossier.
- — Public data: the notices, dossiers, results and information published by the public buyers and institutions we republish.
- — Analyses: the summaries, assessments, reports and dossiers the Service produces from public data, in particular using artificial intelligence models.
4. The Service
The Service gathers tenders and contract results published by public buyers in Morocco and other African countries, and by international institutions; it sorts them, makes them searchable, alerts you, and produces analyses.
Browsing tenders, buyer contacts, estimates and the tender dossier is free. Analyses are paid for in credits.
The Service evolves: we may add, change or remove features and sources. If we remove an essential feature from a paid plan you are on, you may cancel and be refunded pro rata for the unused period.
5. Your account
- — Give accurate information and keep it up to date, especially what appears on your invoices.
- — One login is one person. Your plan’s seats set the number of people; do not share one seat between several.
- — Keep your password and API keys confidential. What is done from your account is deemed done by you, unless you have told us about fraudulent access.
- — Tell us promptly about any access you did not authorise: contact@tender.africa.
You can delete your account at any time from your profile; what then happens to your data is described on the Deleting your account page.
6. The information published on the Service
Public data comes from official portals and buyers’ publications. We collect, extract and structure it with care, but:
- — automatic extraction can contain errors, omissions or delays;
- — a buyer may amend, postpone, suspend or cancel a tender after publication, and we may not have picked that up yet;
- — a deadline we could not confirm is flagged as such in the Service.
The official notice and tender dossier published by the buyer always prevail. Before any decision and any submission, check dates, amounts, conditions and required documents on the buyer’s portal.
Tender Africa is not affiliated with any public buyer, official portal or institution whose publications it republishes, and does not guarantee that every tender is listed.
7. AI-generated analyses
Analyses are largely produced by artificial intelligence models. They are a decision aid:
- — they can contain errors, approximations or omissions, even when they sound confident;
- — they are not legal advice, tax or financial advice, or an expert technical opinion;
- — the decision to bid, the content of your bid and its compliance with the dossier remain your sole responsibility.
Check any analysis against the original documents before relying on it.
8. Plans, prices and payment
Plans and prices are those shown on the Pricing page when you place your request. Prices exclude tax; for customers established in Morocco, VAT at the applicable rate (20%) is added. The currency depends on the country declared for your account.
Payment is by bank transfer, to the details given to you with your request. The plan, or credit pack, is activated as soon as we have received and verified the transfer; send us the proof of transfer to speed this up. An invoice is issued to you.
A subscription runs for one month or one year from activation. It does not renew automatically: you extend it with a new payment. At the end, without renewal, the account returns to the free plan; your remaining credits and bookmarks are kept.
We may change our prices. A new price never applies to a period already paid; for a renewal, we give you at least 30 days’ notice.
9. Credits
- — Each analysis costs a number of credits that depends on its type and on the size of the dossier. The cost is shown before you confirm.
- — A failed analysis is automatically credited back. If the actual work costs less than the announced cost, the difference is returned to you.
- — Credits included in your plan are added every month; unused credits roll over, up to a cap specific to each plan.
- — Credits bought in a pack remain valid for twelve months from purchase.
- — Credits given at sign-up are a free trial.
- — Credits are not money: they cannot be refunded in cash or transferred to another account, and they end with a deleted account.
10. The Founding Member offer
The first 200 accounts — the offer closes as soon as the 200th member joins — get 50% off the subscription price, whatever the plan, for as long as the account exists.
The discount applies to subscriptions, not to credit packs. It is attached to the account: it cannot be transferred, and it does not come back on a new account opened after the old one was deleted.
11. Withdrawal, cancellation and refunds
If you are a consumer within the meaning of Law No. 31-08, you have seven clear days to withdraw from a distance purchase (article 36), without giving a reason. This right no longer applies to a service whose performance began, with your agreement, before that period ended (article 38): this is the case as soon as you use the credits or paid features of your purchase. If you validly withdraw, we refund you within 30 days.
You can stop using the Service and delete your account at any time. The current subscription period is then not refunded, except in the following cases, where we refund the unused part pro rata:
- — we close your account without your having breached these terms;
- — the Service was unavailable for more than seven consecutive days for a reason attributable to us;
- — we remove an essential feature from your current plan (section 4).
12. API and connector for AI assistants
- — API keys belong to the account, are confidential, and can be revoked at any time by you or by us.
- — Request volumes are limited by plan. Exceeding them, or trying to get around them, is not allowed.
- — You may use data received through the API for your organisation’s internal needs, including through your own tools and AI assistants. Any redistribution to third parties, resale or publication of the corpus requires our written agreement.
13. What is not allowed
By using the Service, you agree not to:
- — extract the Service’s content automatically (bots, scraping) other than through the API provided for that purpose;
- — resell, redistribute or republish the Service’s data or analyses, in whole or in part, outside your organisation;
- — share a login or API key beyond your plan’s seats, or get around billing, credits or technical limits;
- — use public officials’ contact details for anything other than the tender procedure concerned — in particular not for unrelated marketing: you are then yourself responsible for that processing under Law No. 09-08;
- — try to access what is not meant for you, disrupt the Service, or decompile its software;
- — use the Service for unlawful activity, or while impersonating another person or company.
14. Intellectual property
The Service — software, design, structured database, analyses, reports and the Tender Africa brand — belongs to IMS or is licensed to it. We claim no rights over official texts published by buyers, which remain public.
We grant you, for as long as you use the Service, a personal, non-exclusive and non-transferable right to use the Service and the analyses you obtain from it for your business. You may share an analysis with the partners in the same bid (consortium members, subcontractors) to prepare that bid.
If you send us a suggestion, we may use it freely, with no obligation to you.
15. Availability
We do our best to keep the Service available and up to date, without guaranteeing that it is uninterrupted or error-free. It may be interrupted for maintenance, and depends on the availability of source portals, which is beyond our control. A service-level commitment exists only if a separate written contract provides for it.
16. Liability
Our obligation is one of means (best efforts), not of result.
We are not liable for indirect damage, in particular: a contract not won, a bid rejected, a missed deadline, lost revenue or lost opportunity — especially where the decision was made without checking the official notice (section 6) or on the sole basis of an analysis (section 7).
In all cases, our total liability in connection with the Service is limited to the amounts you paid us in the twelve months before the event giving rise to it.
These limits do not apply in the event of fraud or gross negligence on our part (article 232 of the Moroccan Code of Obligations and Contracts), nor to rights a consumer holds under mandatory legal provisions.
17. Suspension and termination by IMS
If you breach these terms, we may suspend or close your account after warning you and giving you a reasonable time to put things right. In the event of a serious breach — fraud, security attack, mass extraction, unlawful use — we may suspend access immediately.
We may also discontinue the Service; we will then give you at least 60 days’ notice and refund the unused part of paid subscriptions.
18. Personal data
We process your personal data as described in our privacy policy, which forms part of these terms.
19. Changes to these terms
We may change these terms. For any material change, we will tell you by email or in the app at least 30 days before it takes effect. If you do not accept it, you can delete your account before that date and be refunded pro rata for the unused paid period; continuing to use the Service after that date means you accept it.
20. Governing law and disputes
These terms are governed by Moroccan law.
If we disagree, write to us first at contact@tender.africa: we look for an amicable solution for 30 days.
Failing that, and if you are a professional, the commercial courts of Rabat have sole jurisdiction. If you are a consumer, you keep the benefit of the jurisdiction rules Law No. 31-08 provides in your favour.
21. Final provisions
- — The French version of these terms prevails; the English and Arabic versions are translations.
- — The electronic records of our system — acceptance of these terms, requests, credit consumption — are evidence between us, in accordance with Law No. 53-05 on the electronic exchange of legal data.
- — If a clause were held void, the others would continue to apply.
- — Not exercising a right at a given time does not waive that right.
